It can often be established through the context of a relationship, such as a consumer voluntarily providing a phone number during intake.<\/p>\n<p><strong>Prior express written consent<\/strong> is defined at <a href=\"https:\/\/fransis.ai\/articles\/tcpa-consent-types-explained\" target=\"_blank\" rel=\"noindex nofollow\">47 CFR \u00a7 64.1200(f)(9)<\/a> as a <a href=\"https:\/\/fransis.ai\/articles\/tcpa-consent-types-explained\" target=\"_blank\" rel=\"noindex nofollow\">written agreement bearing the consumer\u2019s signature, including electronic signature under the E-SIGN Act, that clearly authorizes the seller to deliver advertisements or telemarketing messages using an automatic telephone dialing system (ATDS) or prerecorded voice and that includes the specific telephone number to which messages may be sent<\/a>. The agreement must <a href=\"https:\/\/fransis.ai\/articles\/tcpa-consent-types-explained\" target=\"_blank\" rel=\"noindex nofollow\">disclose that consent is not a condition of purchase<\/a>.<\/p>\n<p>In a <a href=\"https:\/\/plura.ai\/ai-sms-leads\" target=\"_blank\" rel=\"noindex nofollow\">text-to-call<\/a> workflow, the consent tier required for the initiating SMS may differ from the tier required for the call that follows. A marketing text and a subsequent AI voice agent call each carry their own consent analysis under the statute. A CRM entry without supporting metadata such as IP address, form version, and server-side timestamp does not meet that burden.<\/p>\n<h2>The April 11, 2025 Revocation Rule In Operational Terms<\/h2>\n<p>The FCC\u2019s consent revocation order was <a href=\"https:\/\/fransis.ai\/articles\/tcpa-revocation-of-consent-rules\" target=\"_blank\" rel=\"noindex nofollow\">adopted February 15, 2024<\/a> and <a href=\"https:\/\/fransis.ai\/articles\/tcpa-revocation-of-consent-rules\" target=\"_blank\" rel=\"noindex nofollow\">took effect April 11, 2025<\/a>. It <a href=\"https:\/\/fransis.ai\/articles\/tcpa-revocation-of-consent-rules\" target=\"_blank\" rel=\"noindex nofollow\">amended 47 CFR \u00a7 64.1200 to require callers to honor a consumer\u2019s withdrawal of prior express consent made by any reasonable method<\/a>. <a href=\"https:\/\/fransis.ai\/articles\/tcpa-revocation-of-consent-rules\" target=\"_blank\" rel=\"noindex nofollow\">Callers may not restrict revocation to a single designated channel.<\/a><\/p>\n<p><a href=\"https:\/\/termsfeed.com\/blog\/tcpa-2025-any-reasonable-means-opt-out\" target=\"_blank\" rel=\"noindex nofollow\">47 CFR \u00a7 64.1200(a)(10) designates seven keywords as per se reasonable revocation triggers: STOP, QUIT, END, REVOKE, OPT OUT, CANCEL, and UNSUBSCRIBE<\/a>. Natural-language expressions such as \u201cstop texting me\u201d or \u201ctake me off your list\u201d are evaluated under a totality-of-circumstances standard. A STOP reply received by an SMS platform must propagate to the dialer before the next call attempt is queued. If the SMS opt-out lives only in the texting platform and the dialer reads from a separate suppression list that has not synced, the queued call still goes out. That call falls outside the revocation window.<\/p>\n<p>A separate \u201crevoke-all\u201d provision, which would treat a single opt-out as applying across all message types from the same sender, <a href=\"https:\/\/burr.com\/telephone-consumer-protection-act\/the-fcc-delays-effective-date-of-tcpa-revoke-all-rule-until-january-31-2027\" target=\"_blank\" rel=\"noindex nofollow\">has been delayed three times<\/a>. <a href=\"https:\/\/burr.com\/telephone-consumer-protection-act\/the-fcc-delays-effective-date-of-tcpa-revoke-all-rule-until-january-31-2027\" target=\"_blank\" rel=\"noindex nofollow\">The FCC\u2019s January 6, 2026 order extended its effective date to January 31, 2027<\/a>, while the Commission reviews whether to modify the requirement. A conversational <a href=\"https:\/\/plura.ai\/ai-voice-demo\" target=\"_blank\" rel=\"noindex nofollow\">AI voice agent<\/a> generating novel speech in real time falls into the same regulatory category as a static prerecorded message under the FCC\u2019s analysis.<\/p>\n<p>Under 47 CFR \u00a7 64.1200(b)(1), all artificial or prerecorded voice messages must state clearly at the beginning of the message the identity of the business responsible for initiating the call. <a href=\"https:\/\/callsphere.ai\/blog\/vw2d-fcc-ai-call-disclosure-rules-2026\" target=\"_blank\" rel=\"noindex nofollow\">The FCC\u2019s September 2024 Notice of Proposed Rulemaking (FCC 24-84) proposed an additional requirement that callers disclose AI use at the start of the call<\/a>, but as of September 2026 that NPRM has not been finalized into a binding rule. Several states have enacted their own AI disclosure requirements independent of federal action, including <a href=\"https:\/\/vosy.ai\/resources\/ai-call-disclosure-requirements\" target=\"_blank\" rel=\"noindex nofollow\">California\u2019s AB 2905, effective January 1, 2025, which requires disclosure when a call uses an AI-generated voice<\/a>.<\/p>\n<p>Operators deploying AI voice agents in outbound workflows should consult qualified counsel to evaluate consent language, identification obligations, and applicable state disclosure requirements for each jurisdiction they contact.<\/p>\n<h2>Calling Windows And State Quiet-Hours Overrides<\/h2>\n<p>The federal TCPA, at <a href=\"https:\/\/leadcompliant.com\/articles\/state-laws\/calling-time-restrictions-by-state-beyond-federal-8am-to-9pm-rule\" target=\"_blank\" rel=\"noindex nofollow\">47 CFR \u00a7 64.1200(c)(1)<\/a>, prohibits telephone solicitations to residential numbers before 8:00 a.m. or after 9:00 p.m. in the called party\u2019s local time zone.
